Terms governing your access to and use of the EDvoki Platform.
Welcome to EDvoki ("EDvoki", "we", "us", or "our"). EDvoki is an education and learning platform that connects students, parents, teachers, tutors and other learning participants through digital educational services, teacher-led sessions, tutoring, hobbies, educational content, communication features and related services (collectively, the "Platform").
These Terms & Conditions ("Terms") govern your access to and use of the EDvoki website, mobile application, platform, services and related features.
By registering for an account, accessing the Platform, booking a service, creating content or otherwise using EDvoki, you agree to these Terms. If you do not agree with these Terms, you must not use the Platform.
EDvoki may be used by parents or legal guardians, students subject to applicable age requirements and parental/guardian consent, teachers, tutors, hobby and skill instructors, and other users permitted by EDvoki.
Parents or legal guardians are responsible for supervising the use of the Platform by children associated with their account.
Users must:
Parent accounts may manage profiles, child/student accounts, bookings, payments and related services.
Students may access permitted educational services.
Teachers, tutors and instructors must provide accurate information, maintain professional conduct, protect student information and comply with applicable laws and EDvoki policies.
Services may include:
Instant bookings depend on teacher availability. Scheduled sessions depend on available time slots. Teachers may accept or reject requests.
Sessions may have statuses such as Pending, Accepted, Rejected, Cancelled, Completed, Running or Expired.
EDvoki may automatically expire sessions when the applicable duration ends and may restrict simultaneous access from multiple devices or tabs.
Prices and applicable taxes/fees will be displayed before or during payment. Payments may be processed by third-party providers.
Where applicable, a parent account or wallet may be used for charges associated with a child account.
EDvoki may use an escrow or settlement mechanism for applicable teacher/service-provider payments.
Prices and fees may change with appropriate notice where required.
Teacher earnings are credited separately to the Teacher Earnings Wallet at the end of the day. These earnings may be withdrawn or used to recharge the wallet for future session payments.
Once transferred to the session-payment wallet, the amount cannot be withdrawn or transferred back to the Teacher Earnings Wallet. Withdrawals from the session-payment wallet are not permitted.
Cancellation and refund rules may vary by service. Refunds may be provided for cancellations by EDvoki, provider unavailability, material technical failure, legal requirements, or where EDvoki otherwise determines a refund is appropriate.
Failure to attend a scheduled session does not automatically guarantee a refund unless the applicable refund policy provides otherwise.
When a student books a session, the session request is sent to the teacher. The session amount is not deducted at this stage and is only deducted from the linked Parent Account Wallet after the teacher accepts the session request. No amount is credited to the teacher at this stage.
If the teacher does not accept or reject the request within 15 minutes, the session request expires and no deduction is made from the Parent Account Wallet.
If the student cancels before the teacher accepts the request, no deduction is made and no refund is required.
Once the session is successfully completed, the applicable session amount is calculated and credited to the teacherβs account at the end of the day.
If the student ends an accepted session before its scheduled duration, the session amount remains payable to the teacher and unused minutes are non-refundable, where applicable. A warning will be displayed before ending the session.
If the student does not join the accepted session, the teacher may end the session after 10 minutes. Where the no-show refund rule applies, the full session amount is refunded to the Parent Account Wallet and no teacher earnings are credited.
If the teacher rejects the session request, no deduction is made from the Parent Account Wallet.
Any applicable EDvoki platform/service fee will be handled according to the applicable fee policy and may remain payable even where the session amount is refunded, unless otherwise required by law or determined by EDvoki.
Teachers, tutors and instructors are responsible for their qualifications, profile information, service quality, professional behaviour, child safety, student privacy and compliance with applicable laws.
EDvoki may verify profiles but verification does not guarantee qualifications, suitability or performance.
Users must not engage in inappropriate communication with children, request inappropriate photographs/videos or unnecessary personal information, attempt unauthorised off-platform communication, or engage in harassment, exploitation or abuse.
EDvoki may suspend accounts, remove content and report matters to appropriate authorities where required or permitted by law.
Users must not:
Users retain ownership of content they lawfully own.
By uploading content, users grant EDvoki a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, distribute and technically process the content as necessary to operate, maintain, improve and provide the Platform.
Users must have the necessary rights and permissions for submitted content.
EDvoki provides educational services and resources for learning and skill development. Content is informational and should not automatically be treated as professional, legal, medical, financial or other specialised advice.
EDvoki may send account notifications, booking confirmations, session reminders, payment notifications, security alerts, service updates and important policy notices.
Marketing communications are subject to applicable consent and preferences.
EDvoki branding, logos, designs, software, interfaces, text, graphics, databases, features and other materials owned or licensed by EDvoki are protected by applicable intellectual property laws.
They may not be copied, modified, distributed, sold, licensed or commercially exploited without permission.
EDvoki may integrate with payment, video, communication, cloud, analytics, authentication and other third-party services. Such services may have their own terms and privacy policies.
EDvoki makes reasonable efforts to maintain the Platform but does not guarantee uninterrupted availability.
The Platform may be unavailable due to maintenance, updates, technical failures, network issues, cybersecurity incidents, third-party interruptions, force majeure or other circumstances outside reasonable control.
EDvoki may suspend, restrict or terminate accounts for violations of these Terms, false information, suspected fraud, safety concerns, legal requirements, unpaid obligations, misuse or security/legal/ operational risks.
Use of EDvoki is also governed by the EDvoki Privacy Policy, which explains how personal information is collected, used, stored, shared and protected.
To the maximum extent permitted by applicable law, EDvoki will not be responsible for indirect, incidental, special, consequential or punitive losses arising from Platform use.
EDvoki does not guarantee specific academic, admission, examination or employment outcomes or uninterrupted services.
Nothing excludes liability that cannot lawfully be excluded.
To the extent permitted by law, users agree to indemnify and hold harmless EDvoki and its directors, officers, employees, contractors and service providers from claims, losses, liabilities and expenses arising from violations of these Terms, misuse, unlawful content, infringement of rights or violation of law.
EDvoki may update these Terms from time to time. Material changes may be communicated through the Platform, email or other appropriate means.
Continued use after the effective date constitutes acceptance subject to applicable law.
These Terms are governed by the laws of India.
Subject to applicable law, disputes shall be subject to the jurisdiction of the competent courts at SAS Nagar (Mohali), Punjab, India.
If any provision is invalid or unenforceable, the remaining provisions continue in effect to the extent permitted by law.
These Terms, together with the Privacy Policy and incorporated policies, constitute the agreement concerning use of the Platform.
By using EDvoki, you acknowledge that you have read, understood and agreed to these Terms & Conditions.
